Terms of Service
01About the Service
Photofra is a mobile application that lets you exchange a set of 5 photos, one-on-one, with an anonymous stranger. This is not a social media platform — there are no likes, follower counts, or viral mechanics of any kind.
Key characteristics of the Service:
- Every trade consists of exactly 5 photos (a "pack")
- You may submit one trade per day
- No personal information about your trade partner is ever shown
- Photos used in a trade cannot be reused (single-use)
02Eligibility
You may use the Service only if you meet all of the following requirements.
- You are 17 years of age or older
- You agree to these Terms
- You can authenticate with an Apple ID or Google account
- Your use does not violate the laws of Japan or the laws of your country or region
Use by anyone under 13 is strictly prohibited. Users aged 13–16 must have parental or guardian consent.
03Your Account
Accounts are created using Sign in with Apple or Google. No username or display name is required.
You are responsible for all activity that occurs under your account. If you become aware of unauthorized access or use of your account, contact us immediately via our contact form.
Creating or maintaining multiple accounts is prohibited. If multiple accounts are detected, all of them may be suspended.
04Photo and Content Rules
What you can submit
Only photos from your own camera roll may be used in a trade. Screenshots, images downloaded from other apps, or photos taken by others may not be submitted as your own.
Prohibited content
The following types of content are prohibited.
- Sexual or obscene content (including nudity and implied sexual acts)
- Violent or graphic content (including self-harm and deceased individuals)
- Content that violates another person's privacy (faces, addresses, contact info without consent)
- Content that infringes on another party's copyright, portrait rights, or trademarks
- Hate speech or discriminatory content
- Sexually suggestive content in which a minor can be identified (CSAM will be reported to authorities immediately)
- Content promoting illegal items or activities (drugs, weapons, etc.)
- Spam or promotional content
Ownership of your content
You retain copyright in photos you submit. However, by submitting photos you grant us a non-exclusive license to use them to the extent necessary to operate the Service (e.g., storing on our servers, running AI filtering). This license ends when you delete the photos or your account.
Photos you receive from a trade partner may only be viewed within the App's collection feature. Forwarding, re-posting, or redistributing received photos to third parties is prohibited.
05How Trades Work
One trade per day
You may submit one pack every 24 hours. A submitted pack cannot be cancelled. Once submitted, the pack cannot be modified while awaiting a match.
Matching
Matches are made automatically by the system. You cannot choose or reject a specific partner. No personal information about your match (user ID, email address, etc.) is disclosed.
Single-use photos
Photos used in a trade cannot be used again in any future trade. This is a core rule of the Service with no exceptions.
Unmatched trades
If no match is found within 24 hours of submission, the trade is automatically cancelled and the photos are released for future use.
06Prohibited Conduct
The following activities are prohibited on the Service.
Content-related
- Submitting another person's photos as your own
- Submitting photos that violate another person's privacy (candid shots, voyeurism, etc.)
- Submitting photos in which another identifiable person appears without their consent
- Using the Service for commercial or promotional purposes
System-related
- Creating or maintaining multiple accounts
- Automated operation via bots or scripts
- Deliberately attempting to circumvent AI filtering
- Unauthorized access to or reverse engineering of the Service
- Any action that disrupts or interferes with the Service
Community-related
- Abusing the report feature for harassment purposes
- Forwarding, re-posting, or sharing received photos on social media
- Using the Service to facilitate illegal activities or transactions
Violations may result in a warning, feature restriction, account suspension, or permanent ban. Serious violations (CSAM, stalking, etc.) will be reported to law enforcement.
07Reporting and Blocking
If a received pack contains inappropriate content, please use the in-app report feature. Reports are reviewed by our team and appropriate action will be taken.
Using the block feature will prevent future matches with that user (identified by an internal ID). Blocks are silent — the blocked user is not notified.
Repeatedly submitting malicious or false reports may result in action against your account.
08Paid Features
The core features of the Service (photo exchange, collection viewing) are free.
We plan to offer the following paid features in the future.
- Archive Access (subscription): Unlimited access to your full trade history
- Custom Effects (one-time purchase): Additional unboxing effects and sounds
- Theme Matching (one-time purchase): Increased matching priority for a specific daily theme
All purchases are processed through the App Store. Refunds are subject to Apple's refund policy. For billing issues, please contact Apple Support.
09Disclaimers
The Service is provided "as is." We are not responsible for the following.
- Damage caused by service interruptions, outages, or data loss
- Disputes arising from trades between users
- Emotional distress caused by received photo content (including content that bypasses AI filters)
- Issues caused by your network or device environment
- Impact of outages from third-party services (App Store, Neon, Cloudflare, etc.)
If you violate these Terms and cause harm to a third party or to us, you are responsible for compensating that harm at your own expense.
10Changes to the Service
We may modify, add, or remove features of the Service without prior notice. For significant changes, we will provide advance notice via in-app notification or on this website.
If we discontinue the Service, we will provide at least 30 days' notice via in-app notification and this website. We will give you the opportunity to download photos from your collection before the service ends.
11Changes to These Terms
If we update these Terms, we will notify you of the changes and effective date via in-app notification and this page. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
For significant changes (such as those that restrict user rights), we will provide at least 30 days' advance notice.
12Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Japan. Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
